Privacy Notice

1. Introduction

Equitas Foundation ("Equitas") makes the Equitas App ("Equitas App" or the "App") for mobile devices available to users ("Users") who wish to operate a Web browser and access external websites with Web3 capabilities. Equitas is the App's data controller, determining the purpose and the means of processing all App-related data. Equitas respects and strictly protects User privacy. All App-related data are processed responsibly and in accordance with the Swiss Federal Act on Data Protection ("FADP").

This privacy notice ("Privacy Notice") explains how Equitas processes data related to the App. It applies exclusively to Equitas App. When Users leave the App, this Privacy Notice no longer applies. Any subsequent website, application, or service accessed by Users is subject to its own terms of service and privacy notice (if any) and not to this Privacy Notice.

Users are advised to read this Privacy Notice carefully. Users who do not agree with this Privacy Notice or any part thereof should not access or use any part of the App. Users who change their mind in the future must stop using the App.

In this Privacy Notice, "Identifying Data" means any information that can be used, directly or indirectly, to identify a natural person and "Usage Data" means any data collected from the App other than Identifying Data.

2. Scope and Purposes of Data Collection and Processing

Identifying Data. Equitas does not collect any Identifying Data from the App, with the sole exception of IP addresses for the exclusive purpose of debugging. In particular, Equitas does not collect any private or public keys.

IP addresses. Equitas may provide the data processors listed on https://www.equitas.app/ ("Data Processors"), if any, with access to IP addresses in full compliance with the FADP's requirements on cross-border data transfers. In case the App running on a device requires debugging and only in such cases, Equitas may collect the device's IP address directly or from a Data Processor for the exclusive purpose of debugging. Equitas retains such IP address only as required for debugging purposes. Equitas never collects IP addresses directly or from a Data Processor if debugging is not required and never uses IP addresses to identify Users or for any other purpose than debugging.

Usage Data. Equitas may collect and retain Usage Data to enhance the App's utility and for other purposes. In processing Usage Data, Equitas may employ tracking technologies comparable to cookies.

3. Sharing of Usage Data

Equitas may share Usage Data with:

• web application publishers that are members of the Equitas Network, on condition that the data recipient cannot relate such Usage Data to an identified or identifiable natural person; and
• service providers who provide services with respect to the App, but solely for the purpose of enabling them to provide their services.

5. Security and Storage

Equitas implements appropriate technical and organizational measures to protect App-related data from unauthorized access, disclosure, or misuse.

Users may choose to use Equitas App to access external cloud storage for encrypted data. Such data is secured by encryption and can only be read using the decryption keys in the User's possession.

6. External Applications

Equitas App enables Users to access and interact with third-party websites, external applications, decentralized applications, and platforms through various means (collectively "External Applications"). This Privacy Notice does not extend to, and Equitas is not responsible for, the privacy practices of any third parties, including but not limited to those that operate External Applications. User interaction with External Applications is subject to their respective terms of use and privacy notices (if any) and is not subject to this Privacy Notice.

The accessibility of an External Application through the App or through a link included in the App does not imply that Equitas endorses the practices of such External Application.

7. Changes to this Privacy Notice

Equitas reserves the right to amend this Privacy Notice at any time to reflect changes in the law, data collection policy, use or sharing practices, or advances in technology. Equitas will make the revised Privacy Notice accessible through the App. Users should review this Privacy Notice periodically. The last revision date included at the beginning of this Privacy Notice indicates when it was last updated.

By continuing to access or use the App, Users confirm that they have read and understand the latest version of this Privacy Notice.

8. Rights of Users

Under FADP, Users have certain rights in relation to their personal data. Users have the right to request access, rectification or deletion of such information, the right to limit or object to the processing of such information, and, in certain circumstances, the right to data portability. If User consent is required, Users can revoke it at any time. If Users wish to exercise any of the above rights, they can send a communication to: info@equitas.app.
